Vancouver – After federal Cabinet approved Kinder Morgan’s Trans Mountain pipeline project and pipeline, condemnation and vows to continue to fight the project were immediate.
“While we are glad that Cabinet has rejected Enbridge’s Northern Gateway pipeline, this does not change the fact that approving the Kinder Morgan project flies in the face of precautionary, evidence-based decision-making and takes Canada in the wrong direction on climate change,” argued Ecojustice lawyer, Karen Campbell. “The federal government insists that it is committed to acting on climate change, but approving Kinder Morgan’s project contradicts its promises and undermines the government’s climate strategy and its international commitments.”
Ecojustice and other conservation groups, as well as many First Nations along the BC south coast, say the Kinder Morgan project would be just as destructive as the Northern Gateway, and it will put both ecosystems and communities at risk in a highly populated region.
Ecojustice lawyers will be working with their clients Living Oceans Society and Raincoast Conservation Foundation in the coming weeks to consider their legal options.
“As we have said in our clients’ ongoing legal challenge to the National Energy Board’s report on the Kinder Morgan project, the Board failed to apply the Species at Risk Act and mitigate impacts on Southern Resident killer whales before it recommended that Cabinet approve the project,”explain Campbell. “Now Cabinet has based its approval of this project on that unlawful report. This chain of flawed decision-making jeopardizes the survival of the endangered Southern Resident killer whales.”
